CONTEST RULES AND REGULATIONS

The contests posted on the Pure Med Spa website are operated by Pure Laser Hair Removal and Treatment Clinic (Canada) Inc., and Pure Laser Hair Removal & Treatment Clinics, Inc., (collectively, “Pure Med Spa”) and is presented to the Registered Entrant (“you”, “registered entrant” and “entrant”, as the case may be) under the following Rules and Regulations, including any amendments thereto and any additional terms and conditions, rules or policies that may be applicable to particular offerings made in connection with any contest (collectively, the “Rules and Regulations”). We reserve the right to update or change these Rules and Regulations from time to time. Any such changes shall be reflected in an updated version of the Rules and Regulations posted on this website. By continuing to register as an entrant following the posting of any such change, you will be deemed to have agreed to the amended version of the Rules and Regulations. Any failure to comply with the Rules and Regulations by you may result in the termination of your registration. BY REGISTERING IN ANY CONTEST, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THESE RULES AND REGULATIONS. PLEASE READ THESE RULES AND REGULATIONS THOROUGHLY AND CAREFULLY.
1. CONTESTS
One (1) Winner will receive a prize, as designated, in any contest and the value and description of such prize will be clearly defined in each contest announcement. The value of prizes will vary between $50 and $5000 per contest and will be US dollars for US resident Winners, or the equivalent amount in CAD dollars for Canadian resident Winner.
2. HOW TO ENTER
Visit Pure Med Spa’s website located at www.puremedspa.com/win1000.php and complete the Entry Registration Form. For the purposes of the contests, "receipt" of an internet registration entry occurs when the entrant’s name, email address, and/or telephone number is received by Pure Med Spa resulting from the entrant clicking the "Register Now to Win" button. Automated entries, including, but not limited to, entries submitted using any robot, script, macro, or other automated service are not permitted and will be disqualified.
There is a limit of one entry per person per contest. Any attempt by a person to obtain multiple entries by using multiple/different email accounts or any other similar methods will render void all of that entrant's entries and registrations and such entrant will be disqualified from the contest. If there is a dispute as to the internet entrant's identity, Pure Med Spa, in its sole discretion, will determine the email account associated with the internet entry and shall be deemed as such for the purposes of the dispute. No form of alternative entry which be accepted by Pure Med Spa from such person.
3. RANDOM DRAWING AND REQUIREMENTS OF CLAIMING PRIZE
A Winner will be selected in a random drawing at the end of each contest from among all eligible entries received. Winners will be notified, at Pure Med Spa’s option, by email or by telephone.
When claiming a prize, the Winner must:
- Sign a standard form provided by Pure Med Spa confirming that by entering the contest:
- he or she read, understood and accepted the Rules and Regulations;
- he or she understands that acceptance of the prize may involve danger and/or exposure to risks and hazards of both manmade and natural origin, whether arising from foreseeable or unforeseeable human error and/or negligence, and that, as a result, he or she may suffer damage to personal property, serious personal injury or illness; that, nevertheless, he or she freely and voluntarily agrees and hereby assumes any and all risks of personal injury and/or illness arising out of or connected with his or her participation in the contest and winning the prize.
- In relation to Canada only, correctly answer, unaided, a time limited, skill-testing mathematical question, provided by Pure Med Spa.
Failure to return the documents described in this paragraph within 10 (ten) days of notification, or if the prize notification is returned non-deliverable, or if the Winner is found not to be eligible or not to comply with the Rules and Regulations, such Winner will be disqualified and an alternate Winner will be selected.
4. ELIGIBILTY
Contests are open to all legal U.S. residents in CA, NV, WA, OR, IN and MO and natural persons of the Province of Ontario unless otherwise specified or prohibited by law. All eligible entrants must be at least 18 years of age as at March 1, 2008. The prize is non-transferable to any other business or provider and will be rendered only by a Pure Med Spa location. The prize has no cash value, may not be redeemed or combined with any other offer or discount and is exclusively for the personal use of the Winner only.
Employees, supervisors, managers, directors or officers of Pure Med Spa and any of their affiliates, and immediate family members of employees, supervisors, managers, directors or officers of Pure Med Spa and their affiliates, are not eligible to participate in any of the contests held and operated by Pure Med Spa.
5. ENTRANT REGISTRATION
In consideration of your registration for Pure Med Spa’s contests, you agree to provide true, accurate, current and complete information about yourself as prompted by the registration form and to maintain and promptly update your personal data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or if any of our service providers have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your registration and to refuse any and all current or future use of the Pure Med Spa website (or any portion thereof) by you. You may not register for a Pure Med Spa contest with a disposable email address. You acknowledge that you must be at least 18 years of age (as at March 1, 2008) to enter a contest and that you may only register one entry per contest.
6. SECURITY OF PERSONAL INFORMATION
We respect your privacy and are committed to protecting the security of your personal information. Please be assured that the information you provide by entering our contests will not be sold to outside or third parties. Please refer to our Privacy Policy on our website for further information.
7. CHANCES OF WINNING
Chances of winning depend on the number of entrant registrations received during the allotted amount of time that each contest is held.
8. EXPENSES
The entrant understands that in the event that they are the Winner of a contest, they are responsible for all incidental expenses incurred in connection with accepting the prize, including, but not limited to, transportation costs to and from the applicable Pure Med Spa location to claim the prize and receive services and/or treatments won as the designated contest prize.
9. LIMITS OF LIABILITY
Pure Med Spa’s employees, officers, directors, affiliates, subsidiaries, distributors, wholesalers, retailers, franchise(s), independent contractors, agents, advertising and promotion agencies, successors and assigns ("Drawing Parties") are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the drawing or by any technical or human error which may occur in the processing of submissions in the sweepstakes. Drawing Parties assume no responsibility for any error, omission, interruption, deletion, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the website, or alteration of entries. Drawing Parties are not responsible for any problems or technical malfunction, or any telephone network or lines, computer systems, servers or providers, computer equipment or software on account of technical problems or traffic congestion on the Internet or a combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in any contest. If, for any reason, the drawing of a contest Winner is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Drawing Parties which corrupts or affects the administration, security, fairness, integrity or proper conduct of this sweepstakes, Pure Med Spa reserves the right to terminate, modify or suspend this drawing at its sole discretion, with or without notice. Drawing Parties: (i) make no warranty, guaranty, or representation of any kind concerning the prize; and (ii) disclaim any express or implied warranties relating to all contests.
10. RESERVATION OF RIGHTS
The contests and its benefits are offered at our discretion, and we have the right to modify or discontinue, temporarily or permanently, any contest, in whole or in part, for any reason, at our sole discretion. We may, among other things, withdraw, limit, modify or cancel any contest. You agree that we will not be liable to you or any third-party for any modification or discontinuance of the draw, in whole or in part.
11. RELEASE
By participating in any contests, entrants agree to release and hold harmless, Pure Med Spa and its respective affiliates, successors, assigns, agents, employees, representatives, shareholders, officers and directors (collectively the “Releasees”) from any and all liability arising in connection with participation in the contest and acceptance of the prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury, including death or damage to or loss of property suffered or incurred or arising from participating in the contest or accepting the prize, whether suffered by the prize Winner, or by his or her heirs, administrators, personal representatives or executors, and not withstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence or gross negligence of any or all of the Releasees.
12. MISCELLANEOUS CONDITIONS
Odds of winning depend on the total number of entries and alternate entries received for any given contest. By participating, entrants agree to abide by and be bound by these Rules and Regulations and the decisions of Pure Med Spa, which shall be final and binding with respect to all issues relating to any contest. By participating, Pure Med Spa may request your name, address, phone number and email address to administer your participation in any contest. At the time you enter any contest, Pure Med Spa will request your permission to opt-in to have future marketing information sent to you from Pure Med Spa via email. If you wish to later opt-out of these marketing emails, you can do so by checking the unsubscribe button on the email. Prizes are non-transferable and non-assignable, with no cash redemption or equivalent and are for personal use of the contest Winner only. All relevant federal, state, provincial and local laws and regulations apply to the contests. By accepting the prize, and where permitted by law, the Winner consents to Pure Med Spa's use and publish of their name, photograph and/or likeness, address, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and Internet), for all legitimate business purposes, including advertising and promotional activities, without compensation, unless prohibited by law. Should a Winner make any false statement(s) in any document referenced above, the Winner will be required to return his/her prize to Pure Med Spa immediately upon Pure Med Spa’s demand, provided that at the time of such demand the Winner has not already received Pure Med Spa treatments as the Winner’s prize. Any federal, state, provincial and local taxes will be the Winner's responsibility. All contest entries are the property of Pure Med Spa, and will not be acknowledged or returned to entrants.
